Met with clients at length to discuss personal and financial objectives to be addressed in planning. Follow up with detailed letter as to what services were to be performed and the fee range for doing so. Conducted meetings with family members to attempt to reach a satisfactory resolution of issues in planning and administration.
Proposed and implemented plan to enable elderly woman to obtain VA benefits once assets reached an appropriate level. Cleared up title to real estate.
Worked with children and financial planners to develop plan for parent to remain in assisted living over time, manage her funds and then qualify for government benefits. This plan also included income tax advice as to mother being dependent upon more than one person and development of multiple person agreement for utilizing tax benefits; and preparation of irrevocable trusts for children to protect assets in event of prior death of a child.
Assisted man whose wife lives in a skilled nursing facility to save farm land through gift of property, and development of family business entity by children. Planning also involved development of irrevocable trust to hold other investments.
Represented individual whose child sued him to resign as trustee of his wife's trust, and filed a petition to have someone appointed as guardian and conservator for the individual, including extended discovery to determine the individual's capacity to serve, and obtain medical records from multiple physicians.
Assisted unmarried partners to develop plan for distribution of assets in the event of death, illness or separation, including preparation of necessary documents.
Develop estate plan for couple with special needs child and other children, establishing a special needs trust. Also set up a self-settled special needs trust using the assets awarded to a child who was involved in a personal injury action. Once the child turned 19, we had her parents appointed as guardian and conservator to protect her assets and herself. We also advised on the income tax effects on a SNT and distributions therefrom.
Analyzed, and planned state for couple with assets potentially subject to estate tax, including consideration and implementation of family business entity, charitable and individual gifting plans, and preparation of various trusts to suit their needs.
Represented client whose elderly relative was removed from her home in another state and brought to Alabama by other relatives. Her revocable living trust specifically provided for her care and what action should fake place if she were absent from her home state for a designated period of time. After family members had her documents changed, relative died and litigation is pending in two states to determine the proper venue for the actions and which documents are valid.
Planned estate planning for mother and disabled daughter to protect the home for the daughter without losing benefits. Created special needs trust.
Planned for childless couple. Husband suffered from Alzheimer's, was in nursing home with wife at own home trying to continue payments for the nursing home and her own home, and still afford her own care. Options considered included use of a reverse mortgage, sale of home, use of VA benefits as well as changing title on assets, and preparing documents to care for at-home spouse.
Planned for mother in nursing home being cared for by daughter. While mother's income was limited, she was the beneficiary of a trust that made occasional significant distributions. To avoid losing Medicaid benefits a pooled trust was used to hold her assets. Her daughter, as co-trustee with the Alabama Family Trust, was advised on proper payment of expenses, and final distribution after mother's death.
Administered estate of single mother whose father was executor and died shortly after being appointed. Executor of father's estate had to be appointed and that executor had to complete filing of single mother's estate settlement.
Dissolved corporations. Assisted re distribution of assets. Changed guardianship and conservatorship from one state to Alabama; prepared estate plan to provide for disabled children, and modified existing trust.
